After filing a foreclosure notice, banks are required to follow very specific guidelines. My firm attorneys will make sure you understand all of your options and explore every possible foreclosure defense, including, but not limited to:

  • Improper assignment of your mortgage from one lender to another.
  • Violations of the Truth in Lending Act.
  • Failure to include required documents, such as a copy of the original mortgage or mortgage assignment, if any.
  • Acceleration clause in the mortgage that requires the lender to take certain steps prior to filing for foreclosure.

These defenses may be able to be rectified by the lender and, thereby, preclude termination of the foreclosure action; however, they can delay the foreclosure action long enough for you to sell your house, refinance or modify the loan, obtain a forbearance agreement or a Deed in Lieu of Foreclosure, or stay in the house long enough to find alternative housing without making a mortgage payment.

If those foreclosure defense options do not work in your case to stop foreclosure, another option is to file for Chapter 13 bankruptcy. This should be considered only if you will have the ability to make the payments ordered by the Court, which will include a prorated past-due payment as well as a current monthly payment.
