Can I file for divorce in Florida while my spouse is stationed with the military in another country?

You can file for divorce is in the military and active duty. However, we do have an act that’s called the Service Member’s Relief Act that says that that person cannot be forced into litigation while they’re active duty. Usually in that situation you want to make sure that you already have an agreement with your spouse. We would probably want to talk to them beforehand and see if we can try to get a settlement agreement because it’s going to be really hard to move forward with that divorce if the person is active duty. Because of course our country wants to protect our service members and they wouldn’t be able to immediately come back for court dates. There’s a lot that goes into it but talk to an attorney and they’ll tell you more about what that is all about.
