When parents are not divorced yet can one parent move with the children out of Florida?
A parent can move but they have to specifically request that from the court. You have to file a special motion. They can’t just automatically move. You have to file a special motion with the court. You have to allege why you are moving, what the reasons are, and the court, there is actually a quick hearing. There has to be a hearing held within 30 days to determine whether or not you are allowed to move with the children. Of course, you could always move yourself but you can’t take the kids away without the court saying that is okay.
