In a divorce, there may be many issues to be resolved in addition to the divorce.  Normally, if you are married then there are children issues to contend with, such as how to divide the time spent with each parent, the amount of child support to be paid, if any, health insurance and uncovered medical and dental expenses, as well as who will make which decisions concerning the children.  A Parenting Plan is required in all divorce proceedings involving children, which should resolve all of these issues.

In addition, real and personal marital property will be equitably distributed between the parties as well as liabilities incurred during the marriage.  There are marital assets and non-marital assets. In general marital assets are those acquired by the parties during marriage using marital funds. Non-marital assets consist of those purchased before the marriage and not commingled with the husband or wife during the marriage.  Liabilities are marital if they are incurred during the marriage by either party.  Generally, liabilities become non-marital after one of the party’s files for divorce.

Alimony is another factor to be determined in a divorce and it in essence depends on the length of the marriage and the income of each party.  There are different types of alimony which also correlate to the length of the marriage.  It could be temporary alimony for a short period of time to get the other spouse back on his or her feet.  It could be for a certain number of years for a specified amount, which cannot be changed.  It could be permanent alimony, which can be changed only if there is a substantial change of circumstances, and lasts for the life of the payor.  If a party to a marriage is ordered to pay alimony then generally they must provide insurance on the payor’s life so that if he or she dies, the payee of the alimony receives the life insurance benefits.
