What is a default divorce?
After you serve the respondent, they would have twenty days to respond to the original petition, what you request from the court. If they fail to file their response within that twenty day time period then you could move for a default against them. After the default is obtained either by the clerk’s office or judicial default, then you can proceed with requesting a final hearing. However, keep in mind that if children are involved, then testimony regarding their best interest is required.
